(“Load Market”, “Load Market Tracking”, “LM Tracking”, “we”, “us”, or “our”)

Thank you for choosing to use Load Market. We are committed to handling personal information responsibly and transparently. This Privacy Policy applies to all websites, mobile applications, APIs, and technology services operated by Load Market (collectively, the “Services”).

This Privacy Policy explains what information we collect, how we use it, how we process data on behalf of our Customers, and the rights and responsibilities associated with the use of our Services.

By accessing or using our platform, websites, mobile applications, APIs, integrations, or any related services (“Services”), you acknowledge and agree to this Privacy Policy. If you do not agree, please discontinue use of the Services.

BY ACCESSING OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS PRIVACY POLICY. IF YOU DO NOT AGREE, YOU MUST DISCONTINUE USE OF THE SERVICES.

1. Scope and Roles

Load Market provides technology solutions that enable freight brokers and carriers (“Customers”) to request, manage, and view shipment tracking information. Depending on the type of information, Load Market acts either as a Data Processor or Data Controller.
1.1 Load Market as Data Processor (Tracking Data)
For all shipment-related tracking information, including vehicle location, telematics, and ELD-derived data (“Tracking Data” or “Telematics Data”), Load Market acts exclusively as a data processor. This includes, without limitation:
  • mobile device GPS coordinates and motion data,
  • ELD-based telematics and location feeds,
  • real-time or historical location pings,
  • route progress and ETA predictions,
  • driver-uploaded BOL/POD documents or images,
  • in-app chat messages or attachments,
  • share tracking link content and metadata,
  • email update content and delivery,
  • risk detection indicators,
  • tracking history subject to limited retention as described below;
As processor:
  • Customers are the sole data controllers for all tracking data.
  • Customers determine the purpose, scope, duration, and method of tracking.
  • Drivers may participate voluntarily, subject entirely to Customer-controlled consent mechanisms and representations.
  • Load Market does not initiate or control any tracking request.
  • Load Market does not determine how tracking data is used, shared, or retained beyond the Customer-controlled configuration.
  • All legal responsibility for tracking data, including obtaining required consents and determining lawful disclosure recipients, rests solely with the Customer.
  • Drivers remain responsible for their own device settings, permissions, and actions taken within the App.
Load Market does not verify, confirm, validate, or document Driver consent for tracking, communications, or data sharing and relies entirely on Customer representations regarding consent, authorization, and legal compliance. Load Market bears no responsibility for obtaining, confirming, or maintaining Driver consent under any applicable privacy, data protection, or telecommunications laws. 

For avoidance of doubt, where tracking or vehicle data is sourced from third-party telematics or ELD providers, Load Market processes such data solely on behalf of the applicable Customer and in reliance on the Customer’s representations regarding lawful access, authorization, and consent. Additional contractual or technical restrictions imposed by such telematics providers may apply to the use, disclosure, or retention of such data.

Independent Telematics Providers.
Third-party telematics and ELD providers from which tracking or vehicle data may originate operate independently of Load Market and act as separate and independent data controllers with respect to data collected through their hardware, firmware, driver assignments, and underlying telematics systems. Load Market does not own, operate, manage, or control such hardware, firmware, devices, or data collection mechanisms and does not determine how such data is initially collected.
1.2 Load Market as Data Controller (Account & Billing Data Only)
Load Market acts as a data controller only for information required to create and administer Customer accounts, including:
  • company information,
  • names and business contact details of account holders,
  • login credentials, passwords, and authentication data,
  • sub-user assignments within Customer organizations,
  • subscription and billing identifiers processed through Stripe,
  • security, login, and access logs.
For this information, Load Market determines the purposes of processing, such as account administration, platform security, fraud prevention, and subscription management.
Load Market does not act as a controller for any tracking data.

2. Information We Collect

2.1 Information Provided by Customers
Customers provide business and user account information to create and manage organization profiles, including:
  • company name, address, and operational details,
  • admin and sub-user emails, phone numbers, and roles,
  • authentication information,
  • billing contact information,
  • API keys used for TMS or ELD integrations.
The Customer is fully responsible for the authorized use of all accounts and sub-accounts created within their organization.
2.2 Tracking Information Processed on Behalf of Customers
Certain tracking and location information processed through the Services may be received from third-party electronic logging device and telematics providers (“Telematics Providers”), when a carrier or other authorized party grants access in connection with a Customer’s use of the Services. Load Market processes such telematics data solely on behalf of the applicable Customer and in reliance on the Customer’s representations regarding lawful access, authorization, and consent.
  • GPS coordinates, device motion, and heading,
  • mobile device data needed for tracking,
  • ELD-derived telematics data supplied by carriers,
  • timestamps, routing points, and progress indicators,
  • driver-uploaded BOL/POD documents, images, or attachments,
  • chat messages exchanged between Customers and drivers,
  • share tracking links and metadata displayed to third parties,
  • email update content configured by Customers,
  • fraud-protection indicators such as:
  • spoofing detection signals,
  • VPN usage,
  • IP address region inconsistencies,
  • multi-device login indicators.
Load Market does not validate, verify, guarantee, or correct any of the above data. Customers and drivers are solely responsible for the accuracy and completeness of all tracking-related information.
2.3 Automatically Collected Information
To maintain the functionality, integrity, and security of the Services, we may automatically collect:
  • device identifiers and system configuration data,
  • IP addresses and geolocation approximations,
  • browser type and operating system,
  • usage logs, crash logs, performance telemetry,
  • authentication and access events,
  • cookies and similar tracking technologies,
  • session identifiers and authentication tokens
This information is collected for security, troubleshooting, and reliability.

We may use cookies and similar technologies strictly for authentication, security, session management, and essential service functionality. Load Market does not use cookies or similar technologies for advertising, behavioral tracking, profiling, or cross-site analytics.

3. Mobile Device Permissions

Depending on your device settings, LM Tracking may request access to:
  • location services (“always allow”),
  • motion and fitness data,
  • camera (for document upload),
  • microphone (for optional voice-related features),
  • SMS Verification Code Access for the sole purpose of account verification,
  • notifications,
  • device identifiers.
Drivers control all permissions. Disabling permissions may prevent successful use of the tracking app.

Load Market does not collect mobile data other than what is explicitly required to fulfill Customer-initiated tracking requests.

4. Use of Information

4.1 When Acting as Data Controller
We use account and billing information to:
  • create and maintain Customer accounts,
  • authenticate user access,
  • manage subscriptions and billing,
  • communicate administrative updates,
  • provide customer support,
  • secure the Services,
  • comply with applicable legal obligations.
4.2 When Acting as Data Processor
We process tracking data solely to:
  • transmit tracking information to Customers,
  • display shipment visibility,
  • support communication between drivers and Customers,
  • generate ETA-related views,
  • deliver email updates configured by Customers,
  • enable TMS integrations,
  • provide fraud detection indicators,
  • store tracking history for up to 90 days.
Customer-configured email notifications or summaries referencing the last recorded vehicle location are generated and transmitted solely on behalf of the Customer and do not constitute disclosure of ELD Data or telematics access.

5. Google Maps and Geolocation Services

Load Market uses Google Maps Platform APIs and other third-party geolocation providers to render maps, calculate routes, and convert coordinates. Use of these services is subject to:
  • Google Maps Platform Terms of Service,
  • Google Privacy Policy,
  • the policies of other location providers we utilize.
These third-party providers may store cookies or retrieve device information solely as needed to provide mapping functionality. Load Market does not control and is not responsible for the data processed by such providers.

Customers acknowledge that map accuracy, GPS signal quality, routing, and related outputs depend on third-party systems.

Load Market does not use tracking data for independent commercial purposes unrelated to providing, securing, maintaining, and improving the Services. Any processing of tracking data is performed solely within the scope of Customer instructions, system integrity, security, fraud-indicator generation, and Service functionality.

6. Sharing of Information

Load Market does not sell personal information.
Tracking and telematics data is disclosed or made accessible solely at the direction of Customers and in accordance with their configurations and instructions. Load Market does not independently determine recipients or purposes of such disclosures.

Such Customer-directed disclosures may include:
  • internal members of the Customer’s organization,
  • carriers or brokers involved in the shipment,
  • TMS systems configured by the Customer,
  • third parties who receive tracking links or email updates.
Sharing of tracking or telematics data derived from or sourced through third-party Telematics Providers is further subject to applicable provider terms, authorization requirements, and technical limitations, and may be restricted or disabled upon revocation of authorization or termination of the applicable integration.

Customers control all sharing and are solely responsible for how and with whom tracking information is shared.

We may also share account-level information with service providers (e.g., hosting, communication, mapping, payment processing) strictly for service delivery.
6.1 Automated Communications, AI Calls, and TCPA Disclaimer
Load Market may process, transmit, or facilitate SMS messages, automated voice calls, AI-generated calls, prerecorded messages, or other automated communications strictly as instructed and configured by Customers.

Load Market:
  • does not initiate such communications on its own;
  • does not review, approve, validate, edit, or monitor communication content;
  • does not verify phone number ownership, identity, or recipient consent;
  • does not determine the legality or compliance of such communications.
Customers are solely and exclusively responsible for:
  • obtaining, documenting, and maintaining all legally required consents;
  • ensuring compliance with TCPA, privacy, consumer protection, and telecommunications laws;
  • the accuracy, legality, tone, and implications of all automated communications.
To the maximum extent permitted by applicable law, Load Market shall have no liability for any claims, penalties, fines, disputes, or damages arising from Customer-initiated automated communications.

Load Market does not provide opt-out, unsubscribe, or preference management mechanisms for Customer-initiated communications, except where explicitly required by law.

7. Employee & Ownership Access Controls

Load Market maintains strict internal access controls.

Access to tracking data is permitted only to authorized personnel who require such access to operate, maintain, support, or secure the Services. Ownership or employment with Load Market does not grant any special or enhanced access to Customer data.

All Load Market personnel - including owners, officers, employees, and contractors - are bound by confidentiality obligations and are strictly prohibited from using Customer data, including tracking information, for any external, personal, competitive, or commercial purpose.
7.1 No Personal Liability of Owners, Officers, and Employees
No individual associated with Load Market—including owners, officers, employees, and contractors—may be held personally liable for any data access, handling, processing, support, maintenance, or operational action performed in connection with the Services. All such actions are deemed actions of the company, not of the individual. Users expressly waive any right to pursue claims against any individual person affiliated with Load Market.
7.2 Exclusive Claims Against the Company Only
All claims or disputes related to data, tracking, privacy, account access, support activities, or use of the Services must be directed exclusively against LM Software Development LLC as the sole legal entity. Users irrevocably waive any right to pursue legal action, damages, or proceedings against any owner, officer, employee, or contractor in their individual capacity.
7.3 Actions Within Scope of Duties Are Company Actions
Any access, review, transmission, troubleshooting, or processing of Customer data performed by Load Market personnel—when conducted within the scope of assigned duties—is considered an official act of the company. Such actions cannot form the basis for individual liability.
7.4 No Private Right of Action Against Individuals
Nothing in this Privacy Policy creates, permits, or grants any private right of action against individual Load Market personnel. No user, driver, broker, carrier, shipper, or third party may assert claims or seek damages from any individual affiliated with Load Market.
7.5 No Third-Party Beneficiaries
This Privacy Policy does not create rights for third parties nor extend liability to any individual person. Users agree that no third party has standing to assert claims against any owner, officer, employee, or contractor.
7.6 Zero Liability for Individuals
To the maximum extent permitted by applicable law, no owner, officer, employee, contractor, consultant, or other individual affiliated with Load Market shall bear any personal liability for any alleged misuse, unauthorized access, error, omission, misunderstanding, or improper handling of data arising from or related to the Services, the Privacy Policy, or the processing of information performed within the scope of their assigned duties.

All such acts or omissions, to the extent any liability exists at all, shall be attributable solely to LM Software Development LLC as a corporate entity and not to any individual person in their personal capacity.

This limitation does not apply to claims arising from willful misconduct or fraud by an individual to the extent that such liability cannot be waived or limited under applicable law.

8. Requests for Corrections and Erasure of Personal Information

If you would like to update or delete your Personal Information or other information that we hold about you, please contact us at office@load-market.com. If you request deletion, we will deactivate or delete your account and information from our active databases. However, we may retain some information to prevent fraud, troubleshoot problems, assist with investigations, enforce our Terms of Service, and comply with legal requirements.

9. Risk Indicators

Load Market may provide Customers with potential risk indicators, including:
  • GPS spoofing or inconsistent device data,
  • VPN or proxy usage,
  • IP address anomalies,
  • multi-device login signals.
These indicators:
  • may be incomplete or inaccurate,
  • may be affected by driver behavior or device conditions,
  • are provided “as-is” and solely for Customer awareness.
Customers are solely responsible for all decisions made based on risk indicators.

10. Data Retention

10.1 Tracking Data
Tracking history and related data may be retained for up to 90 days after tracking ends. Retention periods are indicative only and may be shortened, modified, or eliminated at Load Market’s discretion, including upon account suspension, termination, system limitations, legal requirements, or operational necessity. Load Market has no obligation to preserve or retain tracking data for any minimum period.

Notwithstanding the foregoing, retention is subject to the Terms of Service, and Load Market may delete data earlier at its sole discretion. Any reference to a retention period is descriptive only and does not create a commitment, obligation, or minimum retention guarantee.

Upon revocation of telematics or ELD authorization, termination or suspension of an integration, expiration of access credentials, or receipt of a valid legal, regulatory, or contractual request, Load Market may delete, anonymize, or disable access to the applicable tracking or telematics data within a reasonable period, subject to technical feasibility and applicable legal requirements. Load Market maintains telematics/integration data in a manner intended to allow deletion or disabling of access upon revocation or termination, subject to system design and technical feasibility.
10.2 Account Data
Account-level information is retained as long as necessary to administer Customer accounts and comply with legal, tax, and audit requirements.

11. Data Security

Load Market uses industry-standard safeguards, including encryption in transit, authenticated access, and platform monitoring.

However
  • no system is fully secure,
  • no data transmission is risk-free,
  • Customers and drivers assume responsibility for how they use and share data.
Load Market does not guarantee the accuracy, completeness, continuity, or availability of any tracking data or third-party services.

The implementation of such safeguards does not constitute a guarantee of security, a breach-prevention service, or an assumption of any duty of care, and Load Market disclaims responsibility for security incidents arising from factors outside its reasonable control, including third-party systems, networks, or devices.

No Guarantee of Data Accuracy.
Load Market does not guarantee that any personal data, tracking data, or related information processed, transmitted, or displayed through the Services is accurate, complete, current, or up to date, as such data originates from Customers, Drivers, devices, networks, telematics providers, or other third-party systems outside Load Market’s control.

12. Your Rights

Depending on jurisdiction, Customers may request:
  • access to their account information,
  • correction of inaccurate account details,
  • deletion or deactivation of accounts,
  • updates to billing information.
Requests related to tracking data must be directed to the controlling Customer (broker or carrier). Load Market cannot modify, disclose, or provide tracking data directly to drivers or third parties.

Load Market does not independently respond to data subject requests from Drivers and shall redirect such requests to the applicable Customer, who is the sole data controller.

13. Children's Privacy

The Services are not intended for individuals under 18.
We do not knowingly collect information from minors.
If you are under 18, do not access, use, or provide any information on the Site or on or through any of its features.

14. International Data Transfers

Data is processed in the United States.
By using the Services, you consent to the transfer and storage of data in the U.S. regardless of your location.

15. Updates to This Privacy Policy

We may update this policy as needed.
Changes become effective upon posting to our website.
Continued use of the Services constitutes acceptance of any updates.

16. Dispute Resolution and Governing Law

Any dispute, claim, or controversy arising out of or relating to this Privacy Policy, data processing, or privacy practices shall be governed exclusively by the dispute resolution, arbitration, governing law, venue, class action waiver, and claim limitation provisions set forth in the Terms of Service, which are incorporated herein by reference.
